The paper addresses issues related to the content of part-time employment contracts when the work organization provides for a division into shifts. The analysis is conducted within the framework offered by the Constitutional Court no. 210/1992 and in the light of two recent orders of the Court of Cassation; it considers both the previous legislation (still applicable to contracts stipulated before the entry into force of Legislative Decree no. 81/2015) and the legislation currently in force, the reading of which is caught between interpretative twists aimed at guaranteeing its legitimacy and constitutional censures.
Il contributo affronta le questioni relative al contenuto che deve avere il contratto di lavoro a tempo parziale allorché l’organizzazione del lavoro preveda una articolazione in turni. L’analisi, condotta nella cornice offerta da Corte cost. n. 210/1992 e alla luce di due recenti ordinanze della Corte di cassazione, considera sia la disciplina previgente (tuttora applicabile ai contratti sottoscritti prima dell’entrata in vigore del d.lgs. n. 81/2015), sia quella oggi vigente, la cui lettura è stretta tra torsioni interpretative dirette a garantirne la legittimità e censure di costituzionalità.
