The judgment under review, concerning the authorisation for the placing on the market and use of plant protection products under Article 53 of Regulation (EU) No 1107/2009, investigates the limits and extent of the derogation it provides. La sentenza in esame, relativa all’autorizzazione all’immissione in commercio e all’utilizzo dei prodotti fitosanitari ex art. 53, Regolamento (UE) n. 1107/2009, indaga i limiti e l’estensione della deroga da esso previsti. Pur limitandosi a risolvere un problema di contrasto tra fonti, la pronuncia offre una serie di spunti per l’interprete. Dalle motivazioni del giudice europeo emerge come obiettivo primario della disciplina sull’autorizzazione e l’immissione in commercio dei prodotti fitosanitari sia quello di operare un bilanciamento di interessi tra tutela della salute umana, animale e dell’ambiente e redditività delle colture. Le ultime riforme avviate in occasione della nuova PAC – dai nuovi regolamenti che facilita l’autorizzazione dei prodotti fitosanitari a base di microrganismi alla proposta di regolamento sull’uso sostenibile dei prodotti fitosanitari – seppure orientate agli obiettivi di sostenibilità, dimostrano come la composizione di interessi contrapposti presenti elementi di complessità di non facile risoluzione.
