This essay examines the content of the judgment n. 141/2019 of the Constitutional Court that excludes exercising voluntary and conscious prostitution is a form of expression of sexual freedom and has a nature of fundamental right ex art. 2 Cost. Consequently, it can be excluded that the helping or recruitment of the prostitution constitute forms of facilitating the exercise of a fundamental right and, therefore, that it is unconstitutional to consider them a crime. At the same conclusion, it is also arrive by using as parameter the art. 41 Cost. whereas the prostitution, even a volunteer and aware, is a private economic activity that is not usefully and, moreover, damage the human dignity and more.
