Legal regulation of spaces between buildings focuses an important issue in real property law, since the possibility to introduce exceptions to this rules affects the relationship between private interests and general interests. Actu- ally, the jurisprudence of civil courts introduced a breaking to the principle characterising the whole regulation, according that all these rules are man- datory. Indeed, the Supreme Cort statued that circumstances, otherwise con- sidered contra legem, must be allowed within the limits of private relation- ships only as predial servitude acquired by usucaptio.
