The paper analyzes the changes that have affected the relationship between Public administrations and workers in the post-reform framework. The new configuration of the their subjective positions, which can be ascribed to the subjective right/obligation scheme, typical of Private law relations, is analyzed with reference to various aspects such as the assimilation of Public Administrations' organizational interests to those of private employers, the foundation of the Public Administration's prerogatives as an employer in the work contract, and the implementation of civil and procedural law.
Il saggio analizza i mutamenti che hanno investito il rapporto tra amministrazione pubblica e lavoratore nel sistema post-riforma. La nuova conformazione delle posizioni di questi soggetti, che sono ricondotte alla dinamica diritto soggettivo/obbligo tipica dei rapporti tra privati, viene approfondita con riferimento a vari profili: assimilazione dell’interesse organizzativo dell’ente a quello dei datori di lavoro privati, fondamento delle prerogative datoriali nel contratto, applicazione della legislazione di diritto civile, tutela processuale.
