The judgment of the Regional Administrative Court (T.A.R.) of Lazio, Fourth Quater Section, 5 May 2026, No. 8322, annuls the order issued by the Ministry of Agriculture, Food Sovereignty and Forests requiring the Consorzio Tutela Aceto Balsamico Tradizionale di Modena DOP to cease its bottling activity carried out – on a non‑profit basis and at production cost – for the benefit of all producers, including small and very small ones. This article takes the decision as an opportunity to reconsider the legal and functional nature of DOP/IGP protection consortia in contemporary legal experience. Starting from the systematic interplay between Article 2602 of the Civil Code, Article 53(15) of Law No. 128/1998, and Regulation (EU) 2024/1143, and following the logical‑argumentative path traced by the administrative judge, the paper reconstructs the operative scope of the formula “general care of the interests of the denomination”, understood as an open‑textured clause encompassing material, organisational and logistical activities strictly functional to safeguarding the quality, reputation and economic viability of the certified supply chain. The resulting framework aligns more coherently with the functional profile currently assigned to producer groups within the quality‑scheme system.
La sentenza del T.A.R. Lazio, Sez.

Abstract
The resulting framework aligns more coherently with the functional profile currently assigned to producer groups within the quality‑scheme system.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
