The essay critically analyzes the civil procedure reform (the so-called Cartabia Reform), focusing on the controversial and twofold institution of the hearing of the child (Articles 473-bis.4-473-bis.6 of the Code of Civil Procedure), which is not always set within a “child-centered” perspective. The hearing of the child aged twelve, or under twelve if capable of discernment, represents a procedural tool with undeniable substantive implications. It is indispensable for giving the child a voice and overcoming the adult-centered approach that, despite the openings of the recent reform (direct hearing by the judge, listening methods and techniques, "accelerated" hearing), remains confined to critical areas, such as family crises, behind the guise of consensual management. The best interest of the child is sacrificed by procedural logics that instead conceal unresolved questions of substantive law. In the mixture between procedural and substantive aspects of the new families law, the procedural harmonization to international sources of juvenile rights has left unresolved the need to provide a mechanism that ensures the effective participation of the child in decisions regarding his or her personal future in family crisis, despite the openings resulting from the recognition of the progressive autonomy of the child in the Latin American and European systems.
Il saggio analizza criticamente la riforma sul processo civile (c.d. Riforma Cartabia), con particolare riguardo al controverso e bifronte istituto dell’ascolto del minore (artt. 473-bis.4-473-bis.6 c.p.c.), non sempre inquadrato in una prospettiva “puerocentrica”. L’ascolto del minore dodicenne, o infradodicenne se capace di discernimento, rappresenta lo strumento processuale, dalle indiscutibili ricadute sostanziali, indispensabile per dare voce al minore e per superare quell’approccio adultocentrico che, malgrado le aperture della recente riforma (ascolto diretto del giudice, modalità e tecniche d’ascolto, ascolto “accelerato”), resta, in àmbiti nevralgici come la crisi familiare, confinato dietro la parvenza di una gestione consensuale della stessa. Il best interest of the child viene sacrificato da logiche processuali, che celano invece questioni irrisolte di diritto sostanziale. Nella commistione fra aspetti processuali e sostanziali del nuovo diritto delle famiglie, l’adeguamento processualistico alle fonti internazionali dei diritti minorili ha lasciato insoluta la necessità di prevedere un meccanismo che assicuri al minore una partecipazione effettiva alle decisioni relative al suo futuro personale nella crisi familiare, malgrado le aperture derivanti dal riconoscimento dell’autonomia progressiva del minore nei sistemi latinoamericani ed europei.
