Faced with the risks posed by Artificial Intelligence, the author wonders whether, and to what extent, practical reasoning can act as a bulwark against technocratic drift and the feared extinction of the human race, and enable the law to continue fulfilling its role as ‘guardian of the humanum’. This reflection takes the use of algorithms by public administration as its paradigm and, starting from the principles of algorithmic non-exclusivity and transparency, as well as the general clause of good faith underpinning the duty to protect citizens – which requires, first and foremost, that the functioning of the algorithm be made known and understandable – it arrives at original conclusions regarding the realisation of the ‘human first’ principle and so-called algorithmic legality.
L’interprete, dinanzi ai rischi dischiusi dall’Intelligenza Artificiale, si domanda se e in che misura il ragionamento pratico possa costituire un argine alla deriva tecnocratica e alla paventata estinzione del genere umano e consentire al diritto di continuare a svolgere il proprio ruolo di «custodia dell’humanum». La riflessione prende a paradigma l’amministrare per algoritmi e, partendo dai princìpi di non esclusività algoritmica e di trasparenza, nonché dalla clausola generale di buona fede a fondamento dell’obbligazione di protezione del cittadino, la quale impone in primis di garantire conoscibilità e comprensibilità del funzionamento dell’algoritmo, perviene ad originali esiti in merito alla realizzazione dello human first e della c.d. legalità algoritmica.
