ABSTRACT - The article addresses the issue of choosing between private religious schools and state secular schools. In cases of disagreement between parents, the Italian Supreme Court has identified the best interests of the child as the leading principle. The principle of the best interests of the child thus becomes the secular principle that allows the judge to resolve cases of parental conflict. The principle of secularism in the Italian constitutional system is not a tyrannical value, but rather a helpful method for the pursuit of shared values.
