The handling of terrorist content by online platforms

Regulation 2021/784, adopted on 29 April 2021, introduces a strict deadline for OPs to remove terrorist content after receiving notification from Member State authorities. It establishes the obligation to take proactive measures to facilitate cross-border removal orders within the EU, also outlining sanctions for non-compliance. This Chapter explores the Regulation’s significance, focusing on how it can improve the effectiveness of the fight against terrorism. It also addresses consequential issues, such as the ease with which terrorist content can be reuploaded, even after removal. In addition, these measures conflict with the eCommerce Directive and could affect both the freedom to conduct business and the freedom of expression and information. The control of content is strongly related to the governance of OPs, and the challenge is to find a governance model that upholds individual rights while maintaining a balance between security and protecting the EU’s democratic values.
