The use of biometric surveillance in migration, asylum, and border control processes is becoming increasingly prevalent in European Member States in order to monitor borders and identify individuals transiting through their territories. Another significant application of biometrics pertains to various large-scale IT systems. This Article aims to reconstruct the European legal framework surrounding biometric surveillance, demonstrating that human rights violations are most evident at borders. The measures outlined in the AI Act can certainly be regarded as an important, yet still insufficient, response to the complex issues outlined.
