Brevi considerazioni sul riparto di competenze in materia antiriciclaggio

Drawing on the novelties introduced by the 2024 AML Package, the contribution examines the main issues involved in the centralisation of AML supervisory powers, devoting attention to the legitimacy of the attribution of powers to the EU Authority for Anti-Money Laundering and Countering the Financing of Terrorism (AMLA) as well as to matters on the coordination between the powers granted to AMLA and those already attributed to other national and European authorities. Hence, certain key critical issues related to the new set-up are discussed, questioning their systemic impact.

Prendendo le mosse dalle novità introdotte dal AML Package del 2024, il contributo analizza le questioni sottese alla centralizzazione dei poteri di supervisione antiriciclaggio, soffermandosi sui profili di legittimità dell’attribuzione di poteri all’Autorità europea per la lotta al riciclaggio e al finanziamento del terrorismo (AMLA) e sul coordinamento dei poteri dell’AMLA con quelli già attribuiti ad altre autorità nazionali ed europee. Sono, dunque, esaminate alcune tra le principali criticità del nuovo assetto, interrogandosi sul loro impatto sistematico.
