Status personae e livelli di cura: uno sguardo ai sistemi sanitari europei e la loro risposta all’emergenza pandemica

EU Member States organized very differently their Health systems, considering both financing criteria and territorial articulation. Moreover, they distinguish between people on their territory, not only between citizens and strangers, but also looking at the criteria defined by the EU legislation on migrants and statal ones. The paper looks at the answer the health systems of Italy, France and Sweden provides at the COVID-19 emergency. Particularly, the health right of non-citizens has been threatened by the crisis response provided by the States, because of their economical marginality. However, the States need to correct this approach to guarantee their collective health.

Gli Stati Europei hanno adottato differenti scelte riguardo l’organizzazione, il finanziamento e le regole per l’accessibilità ai propri sistemi sanitari, pur nel perimetro comune definito dalle regole UE. Elementi che hanno contribuito a differenziare il livello di tutela del diritto alla salute, sulla base di uno status personae ulteriormente differenziato rispetto alla mera alternativa tra cittadino e straniero. Tali scelte statali che sono state testate durante la recente pandemia, in cui la tutela di tutte le persone residenti, a prescindere dallo status, è divenuta elemento di interesse comune e fattore necessario per garantire la salute dell’intera collettività.
