Una giustizia di parole. Riflessioni su retorica forense e svolte digitali

The digital transformation of justice affects the rhetorical dimension of the process. Writing with words and writing with numbers are truly different activities. They are based on completely different logics. This distinction is even clearer for forensic rhetoric that is not only marked by the intrinsic structure of words and their connection, but also by their linguistic use in a given environment. Every linguistic rendering is the result of particular and merely possible choices that are difficult to formalise. Nevertheless, in this unprecedented procedural space that is being constructed, forensic rhetoric can still play an important role, provided that the reasons for this are clarified. The essay addresses these issues starting from the classical lesson that rhetoric and argumentation techniques have an inevitable ethical value, because they characterise the lawyer (and the rhetorician) as a virtuous person, without any predefined design or default automatisms.
