The paper focuses on the evolutionary interpretation of art. 44 Cost. in the light of the constitutional revision of art. 9 and 41 Cost. as well as the One Hearth-One Health approach. After examining the new teleological dimension of agricultural activity, the conflict between this and the various “environmental interests” involved in the ecological transition was deepened, with a particular focus on the location of FER installations. It provides a critical framework of the fundamental features of balancing techniques in competing interests.
L’articolo si sofferma sulla interpretazione evolutiva dell’art. 44 Cost. alla luce della revisione costituzionale degli artt. 9 e 41 Cost. nonché dell’approccio One Hearth-One Health. Dopo aver esaminato la nuova dimensione teleologica dell’attività agricola, si è approfondito il conflitto tra quest’ultima e i diversi “interessi ambientali” implicati dalla transizione ecologica, con un focus particolare sulla localizzazione di impianti FER. Ne emerge un quadro critico dei tratti fondamentali della tecnica del bilanciamento nella ponderazione degli interessi concorrenti.
