Dipendenti pubblici in quiescenza e iscrizione alle Organizzazioni Sindacali rappresentative

Art. 28 of Act No. 203/2024 provides, in the first paragraph, the possibility for retired civil servants to join trade unions recognized as representative by Aran, through the issuance of proxy to INPS, similarly to the provisions of a long-stan-ding provision on trade union contributions (Art. 23-octies, Decree-Law No. 267/1972); in the next paragraph, the exclusion of these employees from the cal-culation for the purposes of determining the representativeness of the trade unions in question. The provision – read in light of both the overall system in which it is inserted and the purposes that the legislator intends to pursue – represents a mere mechanism for extending the legal system for collecting membership fees through INPS as provided for by Decree-Law No. 267/1972 for pensioners’ federations adhering to confederations represented within the CNEL to trade unions which, although not represented here, are representative under Art. 43, § 1, of Legislative Decree No. 165/2001.

L’art. 28 della l. n. 203/2024 prevede, al primo comma, la possibilità dei dipendenti pubblici in quiescenza di iscriversi, tramite rilascio di delega all’Inps, alle OO.SS. riconosciute rappresentative dall’Aran, analogamente a quanto previ-sto da una risalente disposizione in tema di contributi sindacali (art. 23-octies, d.l. n. 267/1972); al comma successivo, l’esclusione di questi dipendenti dal computo ai fini della determinazione della rappresentatività delle OO.SS. in questione. La norma – letta alla luce sia del complessivo sistema in cui si inserisce, sia delle finalità che il legislatore intende perseguire – rappresenta un mero meccanismo di esten-sione del sistema legale di riscossione delle quote associative attraverso l’Inps pre-visto dal d.l. n. 267/1972 per le federazioni dei pensionati aderenti a confederazioni rappresentate all’interno del Cnel alle OO.SS. che, pur non rappresentate in questa sede, sono rappresentative ex art. 43, comma 1, d.lgs. n. 165/2001.
