I contratti formativi nelle amministrazioni pubbliche

The essay traces the long series of missed encounters between public administrations and training contracts experienced over the past thirty years, from the inadequacy of the regulation established by Legislative Decree No. 29/1993, to the divergence between the public and private sectors determined by legislative interventions concerning the latter (Legislative Decree No. 167/2011, Legislative Decree No. 81/2015), and did not find implementation in public administrations. It subsequently highlights the invariance of this framework in Decree Law No. 44/2023, which, while referring to the types of apprenticeship and CFL types, in fact introduces extra ordinem recruitment paths in public administrations that are completely disconnected from these. The essay closes with remarks on the loss of opportunities that the failure to (effectively) use of training contracts has led to for public administrations on several levels.

Il saggio ripercorre la lunga serie di incontri mancati tra pubbliche amministrazioni e contratti formativi che si sono registrati negli ultimi trent’anni, dall’inadeguatezza della regolazione posta in materia dal d.lgs. n. 29/1993, alla divaricazione tra settore pubblico e settore privato determinata dagli interventi legislativi che hanno riguardato quest’ultimo (d.lgs. n. 167/2011, d.lgs. n. 81/2015) e non hanno trovato attuazione nelle amministrazioni. Si evidenzia, successivamente, l’invarianza di questo assetto nel d.l. n. 44/2023, che, pur facendo riferimento alle tipologie dell’apprendistato e del CFL, introduce di fatto nelle pubbliche amministrazioni dei percorsi extra ordinem di reclutamento del tutto lontani da queste. Il saggio si chiude con notazioni sulla perdita delle opportunità che il mancato (effettivo) impiego dei contratti formativi ha determinato per le amministrazioni pubbliche su una pluralità di piani.
