This volume explores the unique international legal personality of the Sovereign Military Order of Malta (SMOM), viewed as a sui generis actor in contemporary international relations. Through a rigorous historical and legal reconstruction, the authors trace the transformation of the Order from a medieval chivalric entity with territorial sovereignty to a functionally sovereign institution recognized by more than 100 states. The book delves into its legal sources, the relationship with the Holy See, bilateral diplomatic agreements, and its role within multilateral organizations such as the United Nations. Special attention is given to the Order's current role as a humanitarian diplomacy actor, effectively deploying legally grounded soft power tools in response to crises such as pandemics, forced migration, and armed conflict. The work offers both theoretical and practical insights for scholars of international law, diplomats, and humanitarian practitioners.
Il volume analizza la peculiare soggettività giuridica internazionale del Sovrano Militare Ordine di Malta (SMOM), configurato come attore sui generis nel panorama delle relazioni internazionali. Attraverso una ricostruzione storica e giuridica accurata, gli autori esaminano l’evoluzione dell’Ordine da entità cavalleresca con sovranità territoriale a istituzione dotata di sovranità funzionale, riconosciuta da oltre 100 Stati. Il libro approfondisce le fonti normative, il rapporto con la Santa Sede, le relazioni diplomatiche bilaterali, nonché l’inserimento dello SMOM in organismi multilaterali come le Nazioni Unite. Particolare attenzione è riservata al ruolo contemporaneo dell’Ordine come attore della diplomazia umanitaria, capace di operare in scenari di crisi (migrazioni, pandemia, conflitti) attraverso strumenti di soft power giuridicamente fondati.
