I poteri di vigilanza dell'EBA nell’ambito del Regolamento MiCA. Una nuova “breccia” nella dottrina Meroni?

The MiCA Regulation (Reg. No. 2023/1114) grants the European Banking Authority supervisory powers over the issuers of significant asset-referenced token (ART) and of significant electronic money token (EMT), thus expanding - once again - the extent of the powers granted to the Authority, resulting in significant systemic impacts. As a result, the EBA now also becomes entrusted with direct supervisory powers, similar to what has already been the case with ESMA. The paper, building on the analysis of these ‘new’ powers and their prerequisites, aims firstly to assess whether they are compatible with the Meroni Doctrine. Secondly, to assess the consequences (in terms of level playing field) arising from the attribution to the EBA of supervisory powers over issuers of significant EMT, despite the fact that supervisory powers over EMIs remain with the national authorities.

Il Regolamento MiCA (Reg. n. 2023/1114) attribuisce alla European Banking Authority poteri di vigilanza sugli emittenti di token collegati ad attività significativi (ART) e di token di moneta elettronica significativi (EMT) ampliando – ulteriormente – il novero di competenze dell’Autorità, con rilevanti impatti sistematici. Così, l’EBA diviene titolare anche di poteri di vigilanza diretta, similmente a quanto già avviene da tempo per l’ESMA. Il contributo, muovendo dall’esame di tali “nuovi” poteri e dei relativi presupposti, intende in primo luogo valutarne la compatibilità con la Dottrina Meroni. In secondo luogo, mira a valutare le conseguenze (in termini di level playing field) derivanti dall’attribuzione all’EBA dei poteri di vigilanza sugli emittenti di EMT significativi, nonostante i poteri di vigilanza sugli IMEL rimangano in capo alle autorità nazionali.
