La pars costruens della sentenza della Corte costituzionale n. 192/2024 in materia di autonomia differenziata

The relationship between unity and pluralism is the thread that permeates our constitutional system. The art. 5 of the Constitution in the logic of constitutionalism declines unity and pluralism in synergistic terms. In a logic that tends to put together, reconciling two concepts that could only apparently seem to be in antithesis. Protecting autonomies, guaranteeing territorial autonomies and territorial diversity to express themselves, guarantees the path towards unity, which is not uniformity but the ability to hold together the different characteristics, needs and requests of the territories. Therefore, two souls of a single, entirely composite value coexist in the constitutional system, which is that of the promotion - the maximum possible under the objective conditions of the context - of autonomy in the unity and indivisibility of the Republic or - if one prefers to reverse the terms aforementioned, but without variation in results - is that of unity, in the promotion of autonomy.

Il rapporto tra unità e pluralismo è la trama che permea il nostro sistema costituzionale. L’art. 5 Cost. nella logica del costituzionalismo declina unità e pluralismo in termini sinergici. In una logica che tende a mettere insieme, conciliando due concetti che solo apparentemente potrebbero sembrare in antitesi. Tutelare le autonomie, garantire le autonomie territoriali e le diversità territoriali di esprimersi, garantisce la via verso un’unità, che non è uniformità ma capacità di tenere insieme le diverse caratteristiche, le esigenze e le istanze dei territori. Convivono nel sistema costituzionale, pertanto, due anime di un unico, interamente composito, valore che è quello della promozione - la massima possibile alle condizioni oggettive di contesto - dell’autonomia nella unità ed indivisibilità della Repubblica ovverosia - se si preferisce rovesciare i termini suddetti, ma senza variazione di risultato - è quella della unità, nella promozione dell’autonomia.
