The contribution aims to highlight some profiles of the Roman jurist that emerge from the pages of F. Wieacker's essay Der römische Jurist, included in the collection Vom römischen Recht. Zehn Versuche of the year 1961, from which emerges a variegated portrait traced by following its course articulated in temporal scans, from its initial phase extending to the early 1st cent. BCE, until the rapid collapse around the middle of the 3rd century A.D. Wieacker highlights the distinctive feature of the jurists' activity: the casuistic dimension and the problematic character of their thought (Problemdenken), which does not proceed by deductions starting from general premises and arriving at specific conclusions, but develops by problem areas.
Il contributo si propone di porre in luce alcuni profili del giurista romano che affiorano dalle pagine del saggio di F. Wieacker Der römische Jurist, incluso nella raccolta Vom römischen Recht. Zehn Versuche dell’anno 1961, dal quale emerge un ritratto variegato tracciato seguendone il percorso articolato in scansioni temporali, dalla fase iniziale che si estende all’inizio del I sec. a.C., sino al rapido crollo intorno alla metà del III sec. d.C. Wieacker evidenzia il tratto peculiare dell’attività dei giuristi: la dimensione casistica e il carattere problematico del loro pensiero (Problemdenken), che non procede per deduzioni partendo da premesse generali per giungere a specifiche conclusioni, ma si sviluppa per aree problematiche.
