Resilienza dei modelli familiari tra diritto alla bigenitorialità e tutela del superiore interesse del minore

The challenges posed by the recent pandemic have highlighted the importance of adopting flexible legal solutions, as demonstrated by the extensive body of case law. The right to co-parenting and the best interests of the child remain the fundamental pillars for the protection of affective bonds, but sometimes require a careful balancing with other constitutional principles, such as the right to health. Further legislative intervention is desirable to fill the gap in the recognition of family bonds in same-sex parent families, thus guaranteeing the right to affective continuity in implementation of the principle of uniqueness of the status filiationis in the current plurality of family models.

Le sfide poste dalla recente pandemia hanno sottolineato l’importanza di adottare soluzioni giuridiche flessibili, come dimostra l’ampia casistica giurisprudenziale. Il diritto alla bigenitorialità e il superiore interesse del minore restano i pilastri fondamentali per la tutela dei legami affettivi, ma talvolta richiedono un bilanciamento attento con altri principi costituzionali, come ad esempio il diritto alla salute. Resta auspicabile un intervento del legislatore per colmare il vulnus in materia di riconoscimento dei legami familiari nelle famiglie omogenitoriali, garantendo così il diritto alla continuità affettiva in attuazione del principio di unicità dello status filiationis nell’attuale pluralità dei modelli familiari.
