The paper examines the regulation of the network contract between professionals, as provided for and regulated by Article 12(3) of Law No. 81 of 2017 (Jobs act). The research is conducted as much on a factual level as in an ontological dimension, in order to verify what consequences, the provision of the possibility for intellectual professionals to exercise their activity in an organised form produces, using a legal instrument designed to increase the innovative capacity and competitiveness of subjects that are juridically qualified as entrepreneurs. Therefore, after analysing and solving some of the interpretative and applicative problems that the regulation of the network contract between professionals presents, we will consider the effects that the new instrument has produced with regard to the presumed process of progressively bringing the intellectual professions closer to the legal status of the enterprise.
Il lavoro prende in esame la disciplina del contratto di rete tra professionisti, come previsto e regolamentato dall’art. 12, comma 3, della legge n. 81 del 2017 (Jobs act). L’indagine viene svolta tanto sul piano fattuale quanto in una dimensione ontologica, onde verificare quale valenza debba essere attribuita alla previsione dell’estensione ai professionisti intellettuali dell’ambito soggettivo del contratto di rete e dunque di una forma di esercizio organizzato dell’attività professionale pensata, ab origine, per accrescere la capacità innovativa e la competitività di quei soggetti giuridici che possono essere qualificati come imprenditori. In esito dell’analisi e soluzione di alcuni dei problemi interpretativi e applicativi che la disciplina del contratto di rete tra professionisti presenta, si valuteranno gli effetti che il nuovo istituto ha prodotto in ordine al presunto processo di progressivo avvicinamento delle professioni intellettuali alla fattispecie giuridica dell’impresa.
