Cybersecurity has become of major interest and challenge to the international community and to European Union (EU) for the international peace and security. One of the most common hostile activity in cyber space is cyber espionage, especially when conducted by state or sponsored by it. This activity is prohibited under international law both by the UN Charter, as it violates the principle of sovereignty, of non-intervention, and of self- determination, and by the Budapest Convention on Cybercrime (2001) of the Council of Europe, as it is an unauthorized penetration to computers eventually to steal data.This chapter focuses on cyber threats, and the relations between China and the EU in the context of international law to be applied to malicious operations in cyber space, and it proposes a cooperation framework that may have the potential to reduce tension between the parties due to cyber espionage.
