Abstract: Predictive Algorithms and Prognostic Evaluations for Penal Replacement from the Perspective of Symbiotic Artificial Intelligence New “intelligent” entities aim to cure the fallacy of intuition about the offender’s future behavior and to support the judge in this problematic task. This paper aims to guide the metamorphosis process and to prevent the enthusiasm for something new from ending in an unconscious enslavement of the human being to the algorithmic regime. It proposes a paradigm of interaction between “intelligences” inspired by symbiotic relationships in nature (e.g. between aphids and ants) and provides a concrete example in the context of the new alternative sentences and criminal procedures recently introduced by the so-called “Cartabia reform”.
