The author offers a study on the problem of the transmissibility of legitimate interest, noting that, both in doctrine and in jurisprudence, there are different and conflicting solutions on the topic, mainly due to the different representations of the subjective legal situation. The study's attempt is, on one hand, to highlight the implications that the transfer of legitimate interest could have on the proceeding and the trial and, on the other hand, to propose possible reconstructive alternatives to the problem of the transferability of legitimate interest, considering both the normative data and the structural features of the figure

L’autore offre uno studio sul problema della trasmissibilità dell’interesse legittimo, rilevando come sul tema si siano registrate differenti e contrapposte soluzioni, tanto in dottrina quanto in giurisprudenza, prevalentemente dovute alle diverse rappresentazioni della situazione giuridica soggettiva. Oltre a evidenziare i riflessi procedimentali e processuali della vicenda circolatoria, il tentativo dello studio è di proporre possibili alternative ricostruttive del problema della trasferibilità dell’interesse legittimo, facendo leva sia sul dato normativo che sui caratteri strutturali della figura.
