Appalti e lavoro: frammenti di tutele diffuse

The dissertation deals with techniques to protect the contractor’s employees in the legal system. The first chapter aims to define the area in which the protective measures must be applied. To this end, the contract - and thus the figure of the contractor - is defined from the perspective of labour law. The work also deals with the contract concluded with the public administration, which has the particularity of being regulated by Legislative Decree no. 36/2023 (Public Contracts Code). Particular attention is paid to the European context, as the national protection of contractors' employees in situations with potential cross-border implications may have an impact on the economic freedoms that form the basis of the European Union, but also on the freedom of competition in the European single market. The study has highlighted a rather complex and not always linear framework, characterised by constant legislative changes, fluctuating case law and the growing interest of the social partners.
