The use of Big Data put the digital platform and the market place companies in hyper-dominance position within the market regarding to the value chain of «original and aggregated» data that somewhere could be qualified as anticompetitive conduct (i.e. an exclusionary, binding or self preferencing conducts attributable to the market abuse) as Google Shop and Amazon FBA cases, such as an infringement of art. 102 TFEU. The aim of the study is to verify if the behavioural obligations provided by the regulation EU n. 2022/1925 concerning the fair and constable market of digital service could be a valid and effective instruments to regulate and prevent market abuse conducts from the gatekeepers.
La gestione dei cd. Big Data pone i gestori di piattaforme digitali in una posizione di iper-dominanza sul mercato rispetto alla catena del valore dei dati «originari ed aggregati» che talvolta sfocia in condotte anticoncorrenziali di tipo escludente, legante o di self preferencing riconducibili al genus dell’abuso di posizione dominante (caso Google Shop e caso Amazon FBA) vietato dall’art. 102 TFUE. Il recente Regolamento UE n. 2022/1925 relativo ai mercati equi e contendibili nel settore digitale (c.d. Digital Market Act) costituisce l’occasione per verificare se gli obblighi comportamentali imposti ai gatekeeper siano idonei a prevenire o arginare ipotesi di abuso di posizione dominante.
