AMBIENTE, IMPRESA, RUOLO DELLE ISTITUZIONI: TEMI E QUESTIONI PRELIMINARI PER UN APPROCCI ALLA RICERCA

The essay aims to shows the relationship between the environment and business. It notes how national and d European institutions have assumed a decisive role in allowing the environment to rise to the status of a fundamental principle capable of limiting private economic initiative by channeling the teleological framework of legislation toward a plurality of subjective and collective legal situations that find reference, among other things, in ESG parameters and, therefore, in sustainability.

Il saggio intende evidenziare i rapporti sempre più stretti tra ambiente e imprese. Si rileva come le istituzioni nazionali e d europee abbiano assunto un ruolo decisivo nel permettere all'ambiente di assurgere al rango di principio fondamentale in grado di limitare l’iniziativa economica privata convogliando l’assetto teleologico della legislazione verso una pluralità di situazioni giuridiche soggettive e collettive che trovano riferimento, fra l’altro, nei parametri ESG e, quindi, nella sostenibilità.
