The tragic experiences that mark the beginning of the 21st century (the global pandemic of Covid-19, the wars in the heart of Europe and the Mediterranean, the devastation of natural resources that endangers the survival of the human species) pose poignant questions to the 21st century jurist, not unlike those to which, in the legal reflection of post-war reconstruction, after the two world wars, the Holocaust and totalitarian regimes, legal science attempted to respond. The attacks on the human person (and his dignity) and the environment in this century impose a reflection on current civil law, on the adequacy of its categories and institutions, and the essay is intended as a contribution to this reflection. With the methodology imposed by complexity, the investigation takes its cue from the proposals of global constitutionalism and the attribution of subjectivity to nature and outlines prospects for the effective protection of present and future generations and the planet.
Le esperienze tragiche che stanno contrassegnando l’inizio del XXI secolo (la pandemia globale da Covid-19, le guerre nel cuore dell’Europa e del Mediterraneo, la devastazione delle risorse naturali che mette a rischio la sopravvivenza della specie umana) pongono al giurista del ventunesimo secolo interrogativi pregnanti, non dissimili da quelli ai quali, nella riflessione giuridica della ricostruzione post-bellica, dopo due conflitti mondiali, l’Olocausto e i regimi totalitari, tentò di dare risposta la scienza giuridica. Le aggressioni alla persona umana (e alla sua dignità) e all’ambiente di questo secolo impongono una riflessione sul diritto civile attuale, sull’adeguatezza delle sue categorie e dei suoi istituti e il saggio si pone quale contributo a siffatta riflessione. L’indagine prende le mosse, con la metodologia imposta dalla complessità, dalle proposte del costituzionalismo globale e dell’attribuzione della soggettività alla natura e delinea prospettive per una tutela efficace della presente e delle future generazioni e del pianeta.
