The British Government intends to send some people who would otherwise claim asylum in the UK to Rwanda to seek asylum there, saying that it is safe for refugees. The Supreme Court held in November 2023 that sending asylum seekers to Rwanda is unlawful because it is not safe for refugees. The UK has decided to continue with the policy and has signed a new treaty with Rwanda containing additional safeguards for people relocated. Parliament is now being asked to consider the Safety of Rwanda (Asylum and Immigration) Bill declaring that Rwanda must be treated as safe, in order to render the relocation plan lawful in UK domestic law. The essay aims at analysing the constitutional implications of the Bill considering the UK Supreme Court judgement.
Il contributo prende in esame la sentenza con la quale la Corte Suprema ha dichiarato nel novembre 2023 che il piano governativo di ricollocamento dei richiedenti asilo in Ruanda è illegale perché trattasi di Paese non sicuro per i rifugiati. Il Regno Unito ha deciso, tuttavia, di perseverare e ha firmato un nuovo trattato con il Ruanda contenente garanzie aggiuntive per gli interessati. Il Parlamento è ora chiamato a prendere in esame la Legge sulla sicurezza del Ruanda (asilo e immigrazione) in base al cui disposto il Ruanda è da considerarsi Paese sicuro, ciò al fine di rendere legittimo il piano di ricollocamento nel diritto interno britannico. Il saggio si propone di analizzare le implicazioni costituzionali del disegno di legge alla luce della sentenza della Corte Suprema del Regno Unito.
