Deontologia forense e "fides"

In his Epistulae, Pliny the Younger chooses the expression “advocati fides” to describe the behaviour of an exemplary lawyer. It also encompasses the wise use of rhetorical techniques and argumentation that, before and beyond codes of conduct, characterize the legal profession as a virtuous practical activity. This is the ethical foundation of deontology that shifts the discourse from the realm of “is” to that of “ought-to-be” of a lawyer.

Nelle sue Epistulae, Plinio il Giovane sceglie l’espressione advocati fides per descrivere il comportamento tenuto da un avvocato esemplare. Essa include anche l’uso accorto delle tecniche di ars rhetorica e di argomentazione che, prima e oltre i codici di condotta, connotano la professione legale come attività virtuosa. Si tratta del fondamento etico della deontologia che sposta il discorso dal piano dell’essere a quello del dovere-di-essere di un avvocato.
