With the resolution 2270, approved on March 2nd 2016, the UN Security Council has strongly improved sanctions against the Democratic People’s Republic of Korea. These new sanctions risk to be useless if China doesn’t decide to stop supporting the Kim dynasty. Propaganda, nuclear weapons and human rights violations are at the basis of the Regime that over the last decades has brutally controlled the lives of North Koreans. The aim of this paper is to analyse the Security Council resolutions in the context of the UN collective security system and to evaluate, from a legal perspective, how far is the North Korean member from the San Francisco’s Charter and which consequences this should have on its UN membership.
