Il nostro impegno per la difesa della dimensione costituzionale della giurisdizione

The paper analyzes the relationship between constitutional rules and criminal trial with reference to the interpretative doubts that emerged from the rulings of the Constitutional Court and the European Court of Human Rights. If Unity and plurality of juridical knowledge informs about the recovery of the values of jurisdiction, in a unitary context of knowledge, within which “the law can be placed, as a set of ideas and principles that evolve and grow parallel to the animus of the legal disciplines, vice versa the technique of balancing between different interests seems to privilege social defense and justify the exercise of the punitive power forgetting the semantic value of the criminal process as an applied constitutional right because, the pre-eminent value to be protected was and is the dignity of the accused, as a subject holding intangible rights by the judiciary

Il contributo analizza la relazione tra regole costituzionali e processo penale in riferimento ai dubbi interpretativi emersi dalle pronunce della Corte costituzionale e della Corte Europea dei diritti dell’Uomo. Se unità e pluralità del sapere giuridico informa sul recupero dei valori della giurisdizione, in un contesto unitario del sapere, entro il quale “il diritto possa collocarsi, come un insieme di idee e principi che si evolvono e crescono parallelamente all’animus delle discipline giuridiche , viceversa, la tecnica del bilanciamento tra interessi diversi sembra privilegiare la difesa sociale e giustificare l’esercizio del potere punitivo dimenticando il valore semantico del processo penale come diritto costituzionale applicato poiché, il valore preminente da tutelare era ed è la dignità dell’imputato, quale soggetto titolare di diritti intangibili da parte del potere giudiziario.
