Il contributo si propone di svolgere riflessioni sulla portata effettuale della legge costituzionale n. 1 del 2022 che, come noto, ha modificato gli artt. 9 e 41 Cost. Più in particolare, indaga la differenza che è possibile cogliere tra ciò che essa produce nel breve termine sul tessuto dispositivo preesistente e sul formante giurisprudenziale (comune e costituzionale) e ciò che potrebbe produrre in un futuro (più o meno) prossimo per la naturale tendenza dei principi fondamentali a rappresentare un surplus conformativo delle tendenze ordinamentali e dei comportamenti sociali. The essay aims to carry out reflections on the actual scope of constitutional law n. 1 of 2022 which, as known, amended the articles 9 and 41 of italian Constitution. More specifically, it investigates the difference that can be grasped between what it produces in the short term on the pre-existing internal legal system and on the jurisprudential formant (common and constitutional) and what it could produce in the future close due to the natural tendency of fundamental principles to represent a conformative surplus of regulatory tendencies and social behaviors
