Turismo sostenibile e sviluppo sociale ed economico

The article intends to deepen what role is to be attributed to sustainable tourism, if it is possible to combine tourism and economy respecting the environment and the host population and what institutions can do to encourage the realization of such a form of tourism. The latter, as is known, is among the main economic activities in the world and this involves significant issues since private and also public operators are often led to consider this activity only as a way to make easy profits without taking into account any externalities. negative that it can generate. In this context, it is essential to consider the current legislation regarding sustainable tourism, highlighting how, although there is a copious number of declarations, resolutions, agendas and communications at international and European level (essentially soft law acts), the latter mostly they have proven to be not entirely suitable for importance and expectations, demonstrating most of the time a poor effectiveness. The contribution therefore seeks to investigate which can be the most effective legal instruments for pursuing sustainable tourism in order to better protect the social, cultural, environmental and economic dimension of the places covered by it, while respecting the fundamental rights of the present generations and future, increasing the value of the territories and preserving their peculiar characteristics.

L'articolo intende approfondire quale ruolo è da attribuire al turismo sostenibile, se è possibile coniugare turismo ed economia rispettando l’ambiente e la popolazione ospitante e cosa possono fare le istituzioni per favorire la realizzazione di una tale forma di turismo. Quest'ultimo, come è noto, risulta tra le principali attività economiche del mondo e ciò comporta questioni non trascurabili poiché operatori privati e anche pubblici, spesso sono indotti a considerare tale attività solo come un modo per trarre profitti facili senza tenere conto delle eventuali esternalità negative che esso può generare. In questo contesto è fondamentale considerare la normativa attuale riguardante il turismo sostenibile, evidenziando come, benché vi sia un copioso numero di dichiarazioni, risoluzioni, agende e comunicazioni a livello internazionale ed europeo (atti sostanzialmente di soft law), queste ultime per lo più si sono dimostrate non del tutto adatte all’importanza e alle aspettative, dimostrando il più delle volte, una scarsa efficacia. Nel contributo si cerca quindi, di indagare quali possono essere gli strumenti giuridici più efficaci per perseguire il turismo sostenibile al fine di meglio tutelare la dimensione sociale, culturale, ambientale ed economica dei luoghi oggetto di esso, nel rispetto dei diritti fondamentali delle generazioni presenti e future, incrementando il valore dei territori e preservando le loro caratteristiche peculiari.
