The monograph aims to deepen the new way of understanding cultural heritage and the activities connected to it. It is pointed out that the value of these goods is not only linked to their physical and economic expression, but is also an expression of their fundamental social function, a factor of intellectual development of the community and therefore the object of new social rights. The latter tend to affirm that freedom, equality and dignity of the human person underlined by art. 3, paragraph 2, of the Constitution, in full harmony with the demands of the welfare state and with the new conception of culture developed by our Constitution. It should be noted, however, that the activities that affect cultural heritage, due to their particular nature, are included in the essential levels of the services referred to in art. 117, paragraph 2, lett. m), (pursuant to Legislative Decree no. 146/2015), but also affect the equity aspect of them. In particular, the management, of which we try to understand its peculiar meaning, is the activity that best represents this dichotomy inherent in cultural heritage, showing unprecedented potential for its suitability to "make fruit" the cultural heritage. This activity, however, together with the enhancement of which it is a part, has the important characteristic of being able to be implemented also through the collaboration of private individuals and in implementation of the principle of subsidiarity. For this purpose, the various forms of management are investigated, including those carried out through particular forms of agreement or actual shops between the public and private parties and their critical issues, as well as particular attention is attributed to the function, always in continuous evolution, carried out by the State, by Regions and by local authorities in this sector.
La monografia intende approfondire il nuovo modo di intendere i beni culturali e le attività a essi collegate. Si mette in evidenza che il valore di detti beni non è solo legato alla loro estrinsecazione fisica ed economica, ma, è anche, espressione della loro fondamentale funzione sociale, fattore di sviluppo intellettuale della collettività e perciò oggetto di nuovi diritti sociali. Questi ultimi tendono all'affermazione di quella libertà, eguaglianza e dignità della persona umana sottolineata dall'art. 3, comma 2, Cost., in piena sintonia con le istanze dello Stato sociale e con la nuova concezione di cultura elaborata dalla nostra Costituzione. Si rileva, tuttavia, come le attività che interessano i beni culturali, per la loro particolare natura, sono sì ricomprese tra i livelli essenziali delle prestazioni di cui all'art. 117, comma 2, lett. m), (ex d. lg. n. 146/2015), ma interessano anche l'aspetto patrimoniale di essi. In particolare la gestione, della quale si cerca di comprendere il suo peculiare significato, è l'attività che meglio rappresenta questa dicotomia insita nei beni culturali, mostrando inedite potenzialità per la sua idoneità a "far fruttare" il patrimonio culturale. Tale attività, peraltro, insieme alla valorizzazione di cui è una parte, presenta l'importante caratteristica di poter essere attuata anche attraverso la collaborazione dei privati e in attuazione del principio di sussidiarietà. A tal scopo si indagano le varie forme di gestione, comprese quelle realizzate attraverso particolari forme di accordo o veri e propri negozi tra parte pubblica e privata e le loro criticità, così come particolare attenzione viene attribuita alla funzione, sempre in continua evoluzione, svolta dallo Stato, dalle Regioni e dagli enti locali in questo settore.
