Abstract

There is no law today without rights. And yet, there are many questions, starting with that about the historicity of rights. For some highly accredited theories, it is their historicity that makes them relative, preventing their full and definitive affirmation. The article tries to highlight the current strength of rights, focusing precisely on what appears to be their dark side. Historicity, in fact, if, on the one hand, hinders universal adherence to rights, on the other it is the most reliable demonstration of their true attractive power, despite numerous misunderstandings.
