The essay focuses on Art. 13 of Legislative Decree no. 104/2022, which introduces a special remedial system for the hypothesis of retaliatory employer conduct resulting from com-plaints or proceedings brought to ensure compliance with the rights provided by the decree itself and Legislative Decree no. 152/1997. After analyzing similar measures of protection from retal-iation provided by the legal system at both the EU and national level, the essay examines in depth the case taken into consideration by the norm, first from the standpoint of identifying the relevant employer conduct, secondly with respect to the issue of defining the retaliatory charac-ter that must characterize it. Finally, the procedural process for the application of the sanction is examined, highlighting the many critical issues that result from a certain approximation in the regulations governing the matter and that also affect the established penalty apparatus.
Il contributo verte sull’art. 13 del d.lgs. n. 104/2022, che introduce uno speciale sistema rimediale per l’ipotesi di condotte datoriali di tipo ritorsivo conseguenti a reclami o procedimenti azionati per garantire il rispetto dei diritti previsti dal decreto stesso e dal d.lgs. n. 152/1997. Dopo aver analizzato similari misure di protezione da ritorsioni apprestate dall’ordinamento a livello sia unionale sia interno, si approfondisce la fattispecie presa in considerazione dalla norma, in primo luogo sul piano dell’individuazione dei comportamenti datoriali rilevanti, in seconda battuta su quello della definizione del carattere ritorsivo che deve connotarli. Di seguito è esaminato l’iter procedurale per l’applicazione della sanzione, evidenziando le numerose criti-cità che conseguono a una certa approssimazione nella delineazione normativa dell’istituto, e l’apparato sanzionatorio stabilito.
