The paper examines the reasons for the rejection of the Constitution draft approved by the Constitutional Convention in the plebiscite of September 4, 2022, through a reconstruction of the electoral outcomes, the political environment, and the work of the Convention. The study highlights how, despite the rejection, many innovations were brought in the constituent process, which represents a legacy for the new Latin constitutionalism (Ncl) and the entire global constitutional debate. Finally, a procedural and substantive analysis of the new constituent process, begun with the Acuerdo por Chile of December 2022, is undertaken, highlighting its differences and critical points as compared to the constituent experience that preceded it
