The paper contains some initial reflections on the issues posed by the emerging technology of NFTs and their relationship with Copyright. In the first part, existing and currently widespread cases in reality are identified and described because of the different uses that can be made of NFTs. The authors investigate the changes that the diffusion of these new technologies developed on blockchain may bring in the mechanisms of copyright management, having regard as much to Law and Economics aspects as to positive law. They go on to develop the basic idea that these new cases should be legally treated in a non-unitary way, since different ways of use correspond to different conformations and, therefore, different rules of discipline. Thus, in the last part they deal with the relationship between NFTs and one-off intellectual works, the resale right and the principle of «digital» exhaustion.
Il contributo sviluppa alcune riflessioni iniziali sulle problematiche poste dagli NFT nella prospettiva del diritto d’autore. In una prima parte vengono individuate e descritte le fattispecie di NFT attualmente esistenti distinte in ragione dei diversi usi a cui sono destinate. Gli autori indagano i modi in cui queste nuove tecnologie sviluppate su blockchain possano impattare sui meccanismi di gestione del diritto d’autore, tenendo conto tanto degli aspetti di Law and Economics quanto del diritto positivo. Proseguono sviluppando l’idea che gli NFT non dovrebbero essere trattati in modo unitario, poiché a diverse modalità di utilizzo corrispondono diverse fattispecie giuridiche e, quindi, diverse discipline. Nell’ultima parte vengono affrontate le questioni inerenti al rapporto tra NFT e opere dell’ingegno ad esemplare unico, all’applicabilità del diritto di seguito e quella del principio dell’esaurimento «digitale».
