The article tries to focus Kelsen's position on the role of political parties. Its main purpose is following the coherent approach with which the great Prague jurist looks at the problem, recognizing the main integration actors through which the social pluralism can be organized in a perspective where the representation finds its fundamental fulcrum in the parliament. Once the assumptions from which Kelsen's reasoning starts are addressed, the article tries to examine the reasons with which he contrasts the «anti-party» controversy of an «organicistic» matrix, and beyond; hence exploring the main implications of this position about the conception of democracy.

Abstract
The article tries to focus Kelsen's position on the role of political parties. Its main purpose is following the coherent approach with which the great Prague jurist looks at the problem, recognizing the main integration actors through which the social pluralism can be organized in a perspective where the representation finds its fundamental fulcrum in the parliament. Once the assumptions from which Kelsen's reasoning starts are addressed, the article tries to examine the reasons with which he contrasts the «anti-party» controversy of an «organicistic» matrix, and beyond; hence exploring the main implications of this position about the conception of democracy.File | Dimensione | Formato | |
