Commento all'art. 6. Tutela dei componenti delle Rappresentanze sindacali unitarie

The contribution offers a critical commentary on the art. 6 of Section II of the Metalworking National Collective Labor Agreement, signed by Federmeccanica-Assistal in February 2021; the clause is noteworthy because it guarantees the continuity and effectiveness of the trade union representation relationship between the members of the RSU and those who elected the body against the risk that an employer's decision, albeit legitimate, such as transfer or dismissal, could jeopardize the protection of individual interests (of the representatives) and collectives (of the organizations to which they belong).

Il contributo offre un commento critico dell’art. 6 della Sezione II del Ccnl Industria Metalmeccanica, siglato da Federmeccanica-Assistal nel febbraio 2021; la clausola si segnala perchè garantisce la continuità e l’effettività del rapporto di rappresentanza sindacale tra i componenti della Rsu e i propri rappresentati dal rischio che una decisione datoriale, pur legittima, come il trasferimento o il licenziamento, possa pregiudicare la tutela degli interessi individuali (dei rappresentanti) e collettivi (delle organizzazioni di appartenenza).
