European Union’s Temporary Protection for displaced persons from Ukraine: pros and cons of Implementing Decision (EU) 2022/382 The extreme emergency situation brought about by the Russian invasion of Ukraine has forced millions of people of different nationalities to flee into neighbouring States. In order to ensure the reception of displaced persons, the Council of the European Union, on proposal of the European Commission, triggered Implementing Decision (EU) 2022/382, establishing the existence of a mass influx of displaced persons from Ukraine. By this Decision, Temporary Protection Directive 2001/55 has been implemented for the first time in twenty years. This paper aims to investigate the rules laid down within the EU as well as their application in Italy, laying special emphasis on the scope of Decision 2022/382. Interestingly , temporary protection does not apply to all displaced people in the same way, as eligibility depends on factors, such as status and nationality. Therefore, this situation raises some critical issues, since it might not be entirely consistent with the principle of non-discrimination as well as the principle of solidarity.
La grave situazione di emergenza causata dall’invasione russa dell’Ucraina ha provocato la fuga di milioni di persone di diversa nazionalità verso gli Stati confinanti. Per favorire l’accoglienza degli sfollati il Consiglio dell’Unione europea, su proposta della Commissione europea, ha approvato la decisione di esecuzione 2022/382. Con questa decisione per la prima volta è stata attivata la protezione temporanea introdotta con la direttiva 2001/55. Questo lavoro esamina la disciplina giuridica in vigore e si focalizza, in particolare, sul suo ambito di applicazione soggettiva e la sua attuazione in Italia. Le regole cambiano in funzione della nazionalità e dello status del richiedente protezione temporanea, situazione che non è priva di criticità rispetto ai principi di non discriminazione a motivo della cittadinanza e di solidarietà.
