La giurisprudenza “costituzionale” sulla Brexit nel Regno Unito

Brexit has posed a profound challenge for the British Constitution with a significant impact on the devolution framework - in particular on the relations between Westminster and the devolved legislatures - and the wider constitutional order. The aim of this essay is to comment on the judicial role in this constitutional moment by defining the consequences that may flow from Brexit that concern the stability of the UK’s territorial constitution and the relationship between the judicial and political branches.

Il recesso del Regno Unito dall’UE ha avuto significative ricadute sul sistema costituzionale britannico, con particolare riferimento al processo devolutivo e ai rapporti tra Legislativo di Westminster e Legislativi devoluti. Il saggio si propone di approfondire criticamente il ruolo del Giudiziario nel quadro di questo momento costituzionale le cui conseguenze interessano sia il processo devolutivo sia le interazioni tra il Giudiziario e gli altri poteri.
