Rilievi critici sull'Accordo di Parigi: le sue potenzialità e il suo ruolo nell'evoluzione dell'azione internazionale di contrasto al cambiamento climatico

Adopted in December 2015, the Paris Agreement may be compared to the 1992 United Nations Framework on Climate Change and the 1997 Kyoto Protocol. Regarding the mitigation of climate change, the adaptation to its adverse impacts and the international cooperation, several provisions of the Agreement are indeterminate or merely recommendatory, or grant the Parties a broad margin of appreciation. Furthermore, the review mechanisms are non-punitive and partly based on the implementation of the Agreement by all the Parties. The said weaknesses show a certain reluctance of the States, raising doubts about the potentialities of the Agreement. On the other hand, the Paris Agreement plays a role in the fight against climate change, since it confirms the trends towards the adaptation perspective and facilitation.
