The recent introduction of a third gender register option in Germany and Austria suggests some reflection on the events that break the legal binarism in systems traditionally very close to ours in terms of recognition and protection of fundamental rights. The present contribution examines, therefore, the intersex condition, to which we owe this opening, and the possible impact of the recognition of the third sex on other gender issues that apparently place themselves on the same level of protection.
