La solidarietà tra Stati membri dell’Unione europea nel nuovo Patto sulla migrazione e l’asilo

This paper deals with the solidarity provision included in the New Pact on Migration and Asylum and its related legislative proposals. Starting from a brief overview of the previous situation (para. 1), the paper first of all takes a look into the general features of the solidarity reform and the foreseen measures: relocation, return sponsorship, capacity-building, operational support and cooperation with Third Countries (para. 2). In para. 3, on the other hand, a survey of the three new solidarity mechanisms is carried out, namely that for recurring arrivals after SAR operations, that for situations of migratory pressure and that for crisis situations. A brief mention is also made to the “common but differentiated” solidarity concerning the beneficiaries of international protection (para. 4). In the end, it is stressed that there could be difficulties in the short term in the approval process of the new solidarity system, due to the downwards compromise on which it has been created.

Il contributo esamina le norme solidaristiche contenute nel nuovo Patto sulla migrazione e l’asilo e nelle proposte collegate. Partendo da un breve quadro della situazione precedente (par. 1), nel contributo si analizzano anzitutto i caratteri generali della riforma solidaristica e gli strumenti previsti: ricollocazioni, rimpatri sponsorizzati, sviluppo di capacità, sostegno operativo e cooperazione coi Paesi terzi (par. 2). Nel par. 3, invece, si compie una ricognizione dei tre nuovi meccanismi solidaristici, e cioè quello per gli sbarchi ricorrenti dopo operazioni SAR, quello per le situazioni di pressione migratoria e quello in caso di crisi. Un breve cenno è fatto anche alla solidarietà “comune ma differenziata” concernente i beneficiari della protezione internazionale (par. 4). Infine, si conclude sottolineando la difficoltà di approvare in tempi brevi il nuovo sistema solidaristico a causa del compromesso a ribasso che lo caratterizza.
