Nel caso UAAR - un’organizzazione ateistica, cui il Governo ha negato l’intesa con lo Stato - la Cassazione ha stabilito che l’avvio del procedimento è un atto dovuto e perciò il diniego è impugnabile. L’autore, condividendo questo orientamento ed evidenziando che la conclusione delle trattative è atto politico, punta ad argomentare che la legittimazione all’intesa è solo delle organizzazioni che si dichiarino confessioni religiose. Recenti fenomeni di ateismo militante, specialmente in Inghilterra e in America, potrebbero, tuttavia, mettere in crisi questa interpretazione «originalista» dell’art. 8 Cost. In the case UAAR – an atheistic organization, to which our Government refused to recognize the right to a convention with the State – the Supreme Court ruled that the beginning of the procedure is a due act and therefore its traverse is appealable. The author, subscribing to this ruling and highlighting that the close of the negotiations is a political act, aims at arguing that only the self-styling religious organizations have the legal capacity in order to stipulate this kind of convention. Recent cases of militant aheism, especially in the U.S. and in the U.K., could neverthless endanger this «originalist» interpretation of the Article 8 of the italian Constitution.
