Through a rereading of some classic positions on the relationship between the principle of legality, protection of fundamental rights and the emergency powers, the essay aims to question the constitutional legitimacy of the emergency COVID-19 powers and the impact of the pandemic at social and economic level and on the intra-institutional democracy, in order to reflect on the importance of the centrality of Parliament, rediscovering its fundamental role of formal and substantial protection of democracy.

Abstract

Through a rereading of some classic positions on the relationship between the principle of legality, protection of fundamental rights and the emergency powers, the essay aims to question the constitutional legitimacy of the emergency COVID-19 powers and the impact of the pandemic at social and economic level and on the intra-institutional democracy, in order to reflect on the importance of the centrality of Parliament, rediscovering its fundamental role of formal and substantial protection of democracy.
